Terms of Service

These Terms of Service ("Terms") are a legal agreement between you ("you" or "your") and HabitGrip LLC ("HabitGrip," "we," "our," or "us"). They govern your access to and use of the HabitGrip mobile application for iOS and Android (the "App") and any related services. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use the App. By using the App, you represent and warrant that you meet this requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Account Registration

Some features of the App require you to create an account. When you register, you agree to provide accurate and complete information and to keep your credentials secure. You are responsible for all activity that occurs under your account. If you suspect unauthorized access, you must notify us immediately at support@habitgrip.com.

3. Use of the App

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes in accordance with these Terms. You may not sublicense, sell, or distribute the App or any part thereof.

4. Prohibited Uses

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable law;
  • Attempt to gain unauthorized access to our systems, servers, or other users' accounts;
  • Reverse engineer, decompile, or disassemble the App;
  • Transmit viruses, malware, or other harmful code;
  • Use automated scripts, bots, or scraping tools to access the App;
  • Interfere with or disrupt the integrity or performance of the App;
  • Impersonate any person or entity or misrepresent your affiliation.

5. User Content

You retain ownership of all data you create within the App (habits, tasks, goals, tags, and related content). By using cloud sync, you grant us a limited license to store and transmit your content solely for the purpose of providing the sync service to you. We do not access, use, or share your content for any other purpose.

6. Subscriptions and Payments

Certain features of the App may require a paid subscription. If you purchase a subscription, the following terms apply:

  • Payment is processed through Apple App Store or Google Play Store (the "Platform"). All billing is handled by the Platform, and you are subject to their payment terms.
  • Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date through your Platform account settings.
  • Prices may change with reasonable notice. Continued use after a price change constitutes acceptance.
  • Refunds are handled according to the Platform's refund policy.

7. Intellectual Property

The App and its entire contents, features, and functionality — including all information, software, text, graphics, logos, icons, images, audio, and the design, selection, and arrangement thereof — are owned by HabitGrip LLC, its licensors, or other providers and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

8. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. You may stop using the App at any time. You may delete your account at any time from within the App (Settings > Account > Delete Account). Upon termination, your right to use the App ceases immediately. Sections of these Terms that by their nature should survive termination will remain in effect.

9. Disclaimers

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE APP IS AT YOUR SOLE RISK.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HABITGRIP LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold harmless HabitGrip LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of a third party.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the App shall be resolved exclusively in the state or federal courts located in the State of Washington, and you consent to the personal jurisdiction of such courts.

13. Changes to These Terms

We may revise these Terms at any time by updating this page. If we make material changes, we will update the effective date at the top and, where appropriate, notify you through the App. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

14. Privacy Policy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
